TERMS OF SERVICE

IMPORTANT NOTICE

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE OUR SERVICES.

SECTION 1 — INTRODUCTION & AGREEMENT

These Terms of Service ("Terms") govern your access to and use of the website, mobile application, software, content, and services (the "Platform") operated by Send It Fit Pte. Ltd., a company incorporated in Singapore ("Send It Fit", "we", "us", "our").

These Terms incorporate by reference our Privacy Policy, Cookie Policy, any programme-specific terms, and any other policies posted on the Platform. In the event of conflict between these Terms and any programme-specific terms, the programme-specific terms shall prevail for that programme.

By creating an account, making a purchase, or using any part of the Platform, you confirm you have read, understood, and agreed to be bound by this Agreement in its entirety.

SECTION 2 — ELIGIBILITY

You may use the Platform only if you: are at least 18 years of age, or at least 13 years of age with verified parental or guardian consent; have the legal capacity to form a binding contract under the laws of Singapore; are not prohibited from using the Platform under applicable laws; and have not previously had an account terminated by us for breach of these Terms.

By using the Platform, you represent and warrant that you meet all eligibility requirements.

SECTION 3 — ACCOUNTS & REGISTRATION

Account Creation: You must create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to keep it updated.

Account Security: You are responsible for maintaining the confidentiality of your account credentials. You must not share your password with any third party. Notify us immediately at support@senditfit.com upon becoming aware of any unauthorised access to your account. We will not be liable for any loss arising from your failure to safeguard your account.

Account Responsibility: You are fully responsible for all activity that occurs under your account, whether or not authorised by you.

Accurate Information: Providing false or inaccurate health and fitness data may result in programme recommendations that are unsuitable for you. We are not liable for any harm arising from inaccurate information you provide.

One Account Per Person: You may not create more than one personal account.

SECTION 4 — SERVICES & PLATFORM ACCESS

Description of Services: Send It Fit provides fitness education, training programmes, nutritional guidance, coaching, community features, and related content. The scope of Services available depends on your subscription plan or programme.

Availability: We endeavour to maintain Platform availability but do not guarantee uninterrupted access. The Platform may experience downtime for maintenance or for reasons outside our control.

Modifications to Services: We reserve the right to modify, add, or discontinue any feature or programme at any time. Where a material change adversely affects a paid subscription, we will provide at least 30 days' notice and offer a pro-rated refund for any prepaid but unused period.

No Professional Advice: The Services are provided for general educational and informational purposes only. Nothing on the Platform constitutes professional medical, dietary, clinical, or therapeutic advice. See Section 6 (Health Disclaimer).

Beta Features: We may offer beta or experimental features provided "as is" without warranty, which may be discontinued at any time without notice.

SECTION 5 — PAYMENT, BILLING & REFUNDS

Pricing: All prices are in Singapore Dollars (SGD) unless otherwise stated and are inclusive of applicable Goods and Services Tax (GST). We reserve the right to change prices at any time; price changes will not affect active subscription periods already paid for.

Payment Methods: We accept major credit and debit cards, PayNow, and other methods we may introduce. By submitting payment details, you represent that you are authorised to use the payment method provided.

Recurring Subscriptions: By subscribing, you authorise us to charge your nominated payment method automatically at the start of each billing period until you cancel. You will receive a reminder at least 7 days before each renewal for annual plans.

Failed Payments: If a payment fails, we will attempt to collect payment up to 3 times over a 7-day period. If unsuccessful, access to paid features may be suspended. We will notify you by email of any payment failure.

Cancellation: You may cancel a subscription at any time via account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for partial periods unless required by applicable law.

Refund Policy: We offer a 7-day money-back guarantee for first-time purchasers of any programme or subscription, provided the request is submitted within 7 calendar days of the initial purchase, you have not exceeded stated programme content consumption limits, and the purchase was not made during a promotional period stated to be non-refundable. Refund requests outside this period are considered at our sole discretion. To request a refund, email lets@senditfit.com with your order details.

Taxes: You are responsible for all taxes applicable to your purchase under the laws of your jurisdiction, except where we are required by law to collect and remit such taxes on your behalf.

SECTION 6 — HEALTH DISCLAIMER & MEDICAL ADVICE

Not Medical Advice: The fitness programmes, nutritional guidance, coaching, and all other content provided through the Platform are for general educational and informational purposes only. Nothing on the Platform constitutes medical advice, clinical diagnosis, prescription, treatment, or professional dietary advice. You should not rely on Platform content as a substitute for professional medical or healthcare guidance.

Consult Your Doctor: Before beginning any exercise programme, dietary change, or nutritional supplementation recommended on our Platform, you must consult a qualified medical practitioner, particularly if you have or suspect any underlying medical condition including cardiovascular disease, diabetes, metabolic disorders, osteoporosis, or musculoskeletal injuries; are pregnant, post-partum, or breastfeeding; are taking any prescription medication; are under 18 or over 65 years of age; or have not engaged in regular physical exercise for an extended period.

Assumption of Risk: Physical exercise involves inherent risks of injury including muscle strains, ligament injuries, fractures, and in rare cases cardiovascular events. You voluntarily assume all risks associated with participation in any exercise programme recommended or facilitated by the Platform.

User Responsibility for Health Data Accuracy: By providing health and fitness data, you represent that it is accurate to the best of your knowledge. We bear no responsibility for any harm arising from inaccurate self-reported data.

SECTION 7 — USER CONDUCT & PROHIBITED USES

You must not: violate any applicable Singapore law or regulation; impersonate any person or entity; reproduce, distribute, or create derivative works from Platform content without our prior written consent; reverse-engineer or decompile any software component of the Platform; use automated tools such as bots or scrapers to extract data without our written permission; introduce viruses, malware, or harmful code into the Platform; attempt to gain unauthorised access to any part of the Platform or our systems; harass, bully, threaten, or intimidate other users or our personnel; post content that is defamatory, obscene, hateful, or discriminatory; send unsolicited commercial communications (spam); share your account credentials with others; engage in any activity that disrupts the performance of the Platform; circumvent any access controls or paywalls; or use Platform content to train any artificial intelligence or machine learning model without our prior written consent.

Violation of any of the above may result in immediate suspension or termination of your account, removal of content, referral to law enforcement, and/or civil or criminal legal action.

SECTION 8 —  INTELLECTUAL PROPERTY

Our Intellectual Property: All content on the Platform — including workout programmes, videos, audio recordings, text, graphics, photographs, the Send It Fit name, and logo — is owned by or licensed to Send It Fit and is protected under the Copyright Act 2021 (Singapore) and applicable intellectual property laws.

Limited Licence to You: We grant you a personal, non-exclusive, non-transferable, revocable, limited licence to access and use the Platform and its content for your own personal, non-commercial fitness purposes only. This licence does not include the right to resell, sublicence, or share access; reproduce or distribute content; use content for commercial purposes; or remove any proprietary notices.

Trade Marks: "Send It Fit" and the Send It Fit logo are trade marks of Send It Fit LLP. You may not use these marks without our prior written consent.

Feedback: If you provide suggestions or feedback regarding the Platform, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use and incorporate such feedback into our products without any obligation to you.

SECTION 9 — USER-GENERATED CONTENT

Your Content: You retain ownership of any content you post on the Platform including progress photos, comments, and forum posts. By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute such content solely for the purposes of operating and promoting the Platform.

Content Standards: User content must not infringe any third party's intellectual property or privacy rights; be false, misleading, or defamatory; contain hate speech or graphic violence; promote illegal activities; or violate any applicable law.

Content Moderation: We reserve the right to review, remove, or restrict any user content that violates these Terms or that we deem harmful or offensive, at our sole discretion and without prior notice.

No Endorsement: User content reflects the views of individual users and does not represent the views or endorsement of Send It Fit.

SECTION 10 — THIRD-PARTY SERVICES & LINKS

The Platform may contain links to or integrations with third-party websites, applications, or services including fitness wearable platforms, payment processors, and social media networks. These are governed by their own terms and privacy policies. We do not control, endorse, or accept responsibility for any third-party services. Your use of third-party services is entirely at your own risk.

SECTION 11 — DISCLAIMERS & WARRANTIES

The Platform and all Services are provided on an "as is" and "as available" basis without warranty of any kind. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant or guarantee any specific fitness, health, aesthetic, or performance result from use of our Services. Results vary significantly between individuals based on factors including genetics, adherence, medical status, and lifestyle.

Nothing in these Terms excludes, restricts, or modifies any right or remedy implied or imposed by the Consumer Protection (Fair Trading) Act (Singapore) or any other applicable mandatory consumer protection legislation that cannot lawfully be excluded or limited.

SECTION 12 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Send It Fit and its directors, officers, employees, agents, coaches, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the Platform or Services, including loss of profits, loss of data, personal injury, or property damage, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to these Terms shall not exceed the greater of: (a) the total amount you paid to us in the 12 months immediately preceding the claim; or (b) SGD 100.

Nothing in this section limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable Singapore law.

SECTION 13 —  INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Send It Fit, its affiliates, and their respective directors, officers, and employees from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: your use of or inability to use the Platform; your breach of any provision of these Terms; any content you post or submit; your violation of any applicable law or the rights of any third party; or your provision of inaccurate health or personal data.

SECTION 14 — TERMINATION & SUSPENSION

Termination by You: You may terminate your account at any time via account settings or by contacting lets@senditfit.com. Your access to paid features will cease at the end of the current billing period unless you have a refund entitlement.

Termination or Suspension by Us: We may suspend or terminate your account without prior notice if you breach any provision of these Terms; if we are required to do so by law or a competent authority; if your account has been inactive for more than 24 consecutive months; or if we reasonably believe your account has been compromised or is being used fraudulently.

Effect of Termination: Upon termination, your licence to use the Platform ceases immediately. Provisions that by their nature should survive termination will do so, including Sections 8, 11, 12, 13, 15, and 16.

SECTION 15 — GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. The courts of Singapore shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.

SECTION 16 — DISPUTE RESOLUTION

Informal Resolution: Before initiating any formal proceedings, you agree to contact us at lets@senditfit.com and allow at least 30 days for us to attempt to resolve the dispute informally.

Mediation: If informal resolution is unsuccessful, either party may refer the dispute to mediation administered by the Singapore Mediation Centre (SMC) in accordance with its prevailing mediation rules. The language of mediation shall be English.

Arbitration: If mediation is unsuccessful, either party may refer the dispute to final and binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its Arbitration Rules. The seat of arbitration shall be Singapore. The language shall be English. The arbitral tribunal shall consist of one arbitrator. The decision shall be final and binding on both parties.

Either party may seek emergency or interlocutory relief from a Singapore court to prevent irreparable harm pending the outcome of arbitration.

Class Action Waiver: Any dispute resolution proceedings will be conducted on an individual basis only and not as a class, collective, consolidated, or representative action.

SECTION 17 — GENERAL PROVISIONS

Entire Agreement: These Terms constitute the entire agreement between you and Send It Fit with respect to the Platform and supersede all prior agreements and representations.

Severability: If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

Assignment: You may not assign any of your rights or obligations under these Terms without our prior written consent. We may freely assign our rights, including in connection with a merger or acquisition, upon notice to you.

Force Majeure: We shall not be liable for any delay or failure to perform where such delay arises from circumstances beyond our reasonable control, including acts of God, pandemics, government actions, power outages, or internet infrastructure failures.

Notices: All notices to us must be sent in writing to lets@senditfit.com. Notices to you will be sent to the email address associated with your account.

Language: These Terms are in English. If translated, the English version shall prevail in the event of any inconsistency.

Updates to These Terms: We may update these Terms from time to time. Material changes will be communicated at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
